DMCA Copyright Policy

Broadimage ("we", "us") respects the intellectual-property rights of others. This DMCA Copyright Policy explains how to submit copyright-infringement notifications under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) for content available on the contributor portal at upload.broadimage.com and how we respond.

1. Repeat-infringer policy

It is Broadimage's policy to terminate, in appropriate circumstances, the contributor accounts of users who are repeat infringers of copyright. Repeat-infringer determination is made at our sole discretion, with reasonable consideration of the totality of circumstances.

2. Reporting copyright infringement (Notice of Infringement)

If you believe content available on upload.broadimage.com or distributed through our network infringes your copyright, you may submit a written DMCA notification to our Designated Copyright Agent.

To be effective under 17 U.S.C. § 512(c)(3), your notification must include all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work claimed to have been infringed (or, in the case of multiple works on a single site, a representative list).
3. Identification of the material claimed to be infringing, with sufficient detail to enable us to locate it (e.g., direct URLs to the specific page, image, or video).
4. Your contact information: name, address, telephone number, and email.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, the owner's agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

3. Designated Copyright Agent

Submit DMCA notifications by email to dmca@broadimage.com with the subject line "DMCA Takedown Notice — [your name]". For postal notification, request the current mailing address from legal@broadimage.com.

4. How we respond to a valid DMCA notice

1. Review and action. Upon receipt of a valid notification, Broadimage will expeditiously remove or disable access to the allegedly infringing material.
2. Notice to user. We will provide notice of the removal to the contributor who posted the material, including a copy of the DMCA notice, and inform the contributor of the counter-notification procedure.
3. Logging. We log the takedown action in our compliance records and apply our repeat-infringer policy where applicable.

5. Counter-notification

If you are a Broadimage contributor and you believe content of yours that was removed (or to which access was disabled) was a mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3) to our Designated Agent. To be effective, your counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or if your address is outside the United States, the federal court for any judicial district in which Broadimage may be found, including the U.S. District Court for the Central District of California), and that you will accept service of process from the person who provided the original notification or from an agent of that person.

Send counter-notifications to dmca@broadimage.com with the subject "DMCA Counter-Notification".

6. How we respond to a counter-notification

Upon receipt of a valid counter-notification, we will provide a copy to the original notifier and inform them that we will restore the removed material in 10 to 14 business days unless the notifier first notifies our Designated Agent that they have filed an action seeking a court order to restrain the contributor from engaging in infringing activity related to the material.

7. False statements and bad-faith notifications

The DMCA holds parties accountable for false statements. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents (a) that material or activity is infringing or (b) that material was removed or disabled by mistake or misidentification, may be liable for damages, costs, and attorneys' fees.

8. Trademark and other complaints

For trademark, right-of-publicity, defamation, or privacy complaints (which are not covered by the DMCA), email legal@broadimage.com with a detailed description of the complaint and your contact information.

9. International copyright complaints

Broadimage is a U.S.-based company subject to U.S. copyright law and the DMCA. We will also evaluate copyright notifications made under the laws of other jurisdictions where applicable. Notifications based on non-U.S. copyright law should be sent to legal@broadimage.com with the relevant statutory citations and a description of the claimed infringement.

10. Changes to this policy

We may update this DMCA Copyright Policy from time to time. The "Last Updated" date at the top reflects the most recent change.
