Users include contributors, editors, admins, and client licensees. You are responsible for account credentials and for activity under your account.
Contributors retain copyright. By uploading, you grant Broadimage a license to host, process, display, distribute, and sub-license to editorial clients per the Editorial Content License Agreement. You warrant that you have the necessary rights, and that your uploads comply with laws and third-party rights.
Client downloads and uses of Content are subject to the Editorial Content License Agreement and any specific Order.
Admins control who can route to client groups. Users with “Send to Desk” can only deliver internally until approval. “Livestream” users may distribute automatically to preassigned groups upon upload for active assignments.
All Broadimage software, trademarks, and designs are owned by Pop Shutter Media Network, LLC or its licensors. Except as permitted, you may not copy, modify, or create derivatives of the services.
If you believe Content infringes your rights, contact: dmca@broadimage.com. We respond to valid notices and may remove or disable Content pending review.
The services are provided “AS IS”. To the maximum extent permitted by law, Broadimage disclaims implied warranties and excludes liability for indirect or consequential damages.
We may suspend or terminate your access for policy or legal violations. You may stop using the services at any time.
These Terms are governed by the laws of the United States and the State of California. Disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California. Notwithstanding the foregoing, Pop Shutter Media Network, LLC (owner of Broadimage, Inc) may bring claims worldwide in any jurisdiction with competent authority where the infringement or harm occurs.
We may update these Terms periodically. Continued use signifies acceptance of the updated Terms.
